Foreclosure

Foreclosure Defense — Choose Your Market

A sale date is a calendar problem as much as a money problem. Chapter 13 can pause many foreclosure sales and spread missed payments over a three- to five-year plan. Choose the office that files in the court that covers your home.

Choose Your Market

Foreclosure procedure is local. Michigan sheriff’s sales, Maryland circuit-court foreclosures, and D.C. sales do not run on the same clock.

Why Waiting on a Modification Is Risky

A loan modification depends on the lender saying yes. A Chapter 13 filing does not ask permission. The automatic stay generally pauses the sale once the case is filed, and missed payments can be addressed inside the plan while you remain in the home.

Many clients pursue both: the plan protects the house while a modification is still being reviewed. The point of the consultation is to put a date on that strategy before the sale date does it for you.

Chapter 13 vs. Chapter 7 When a House Is at Risk

Chapter 13 is usually the tool when the goal is to keep a house that is behind. Chapter 7 may still be the better chapter when the unsecured debt is the crisis, equity is protectable, and the mortgage is current — or when keeping the property is not the goal.
